Chapter 13 is a re-organization plan designed to help people who are behind on payments to creditors on debts for property they want to keep or are not to be discharged. These include house payments, car loans, tax debt, student loans and support, to name a few. Chapter 13 is an excellent program that allows you to catch up on these debts by paying monthly payments to a Chapter 13 Trustee over a 3-5 year period. Unsecured debts are paid a percentage, with the balance being discharged at the end of the re-payment period.
How it works
When we meet we gather all your financial information regarding income, assets and debt. In order to qualify for a Chapter 13, you must have disposable income. That means that you have money left after paying living expenses which is paid over to the trustee who pays creditor claims. An example looks like this:

Chapter 13 is quite complicated and should not be attempted on your own. In fact, most Bankruptcy Lawyers do not attempt to file Chapter 13's.

Stops Interest and Penalties- Unsecured debts owed on the date the Chapter 13 is filed do not accrue interest or penalties during the life of the Chapter 13 plan, in most circumstances.
Co-signer protection- The filing of a Chapter 13 also protects those who have co-signed on your debts.
Lien Strip- A second mortgage on your personal residence may be subject to being “stripped off”, removing it from title on your property.
